Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the iaptic.com service (the "Service") operated by Iaptic, SAS ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

iaptic.com ("Service") is a software as a service platform operated by iaptic that provides receipt validation and subscription management for mobile and web applications. The Service includes server-side receipt validation, subscription tracking, analytics, and real-time sales insights across multiple platforms (including Apple App Store, Google Play Store, and Stripe).

The Service processes transaction data and receipts from your application to validate purchases, manage subscriptions, and provide analytics. All data processing is conducted in accordance with our Privacy Policy .

While we strive to maintain high availability, we do not guarantee uninterrupted access to the Service. We reserve the right to modify or suspend the Service at any time.

3. Account Registration and User Responsibilities

3.1 To use the Service, you must:

  • Be at least 18 years old
  • Register for an account with accurate, complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your account information
  • Ensure your use complies with these Terms and applicable laws

3.2 You are responsible for:

  • All activities that occur under your account
  • Maintaining the confidentiality of your account credentials
  • Notifying us immediately of any unauthorized use of your account

3.3 We reserve the right to suspend or terminate accounts that:

  • Provide false or misleading information
  • Violate these Terms or applicable laws
  • Engage in fraudulent or suspicious activity
  • Have been inactive for an extended period

4. Payment and Billing

4.1 Pricing Plans

The Service is offered in multiple tiers (FREE, START, PRO, and BUSINESS), each with different transaction and request limits. Current pricing and plan features can be found at iaptic.com/pricing. We recommend reviewing the pricing page for the most up-to-date information about our plans and their features.

4.2 Billing Cycles

Subscriptions may be billed monthly or annually, at the customer's choice. All payments are processed through Stripe, our payment processor. We accept credit cards and bank transfers.

4.3 Usage Overage

Exceeding plan limits is permitted. When quotas are exceeded:

  • You will receive notification requesting a plan upgrade
  • For usage beyond BUSINESS plan limits, additional charges apply at $0.005 per transaction and $0.005 per 1,000 requests
  • Overage charges are invoiced at the end of each billing period

4.4 Refunds and Cancellation

  • Subscriptions may be cancelled at any time through your account dashboard
  • Upon cancellation, service continues until the end of the current billing period
  • No refunds are provided for partial billing periods
  • For annual subscriptions, refunds may be requested within 14 days of purchase, in accordance with French consumer protection laws

4.5 Changes to Pricing

We reserve the right to modify our pricing with 30 days advance notice. Changes will not affect existing subscriptions until their next renewal date.

5. Intellectual Property Rights

5.1 iaptic retains all right, title, and interest in and to the Service, including all related intellectual property rights. This includes, but is not limited to, the software, the platform, APIs, SDKs, documentation, and any modifications or improvements to the foregoing.

5.2 Subject to these Terms, iaptic grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your business purposes in accordance with these Terms.

5.3 You retain all rights to your application(s), transaction data, and any content you submit to the Service. By using the Service, you grant iaptic a worldwide, non-exclusive license to process, analyze, and store such data as necessary to provide and improve the Service.

5.4 Nothing in these Terms transfers ownership of any intellectual property rights from one party to the other.

6. Acceptable Use and Restrictions

6.1 You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

6.2 When using the Service, you agree not to:

  • Attempt to circumvent any service limitations or restrictions
  • Use the Service to process transactions for illegal goods or services
  • Share your account credentials with unauthorized third parties
  • Reverse engineer or attempt to extract the source code of our Service
  • Use the Service in any way that could damage, disable, or impair its functionality

6.3 You are responsible for maintaining the security of your account credentials and any integration keys or tokens provided by the Service.

7. Limitation of Liability

7.1 To the maximum extent permitted by applicable law, iaptic and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service

7.2 In no event shall iaptic's total liability to you for all damages exceed the amount you paid to iaptic over the 12 months preceding the incident giving rise to the liability, or €100 if you have not paid iaptic anything.

7.3 The limitations of damages set forth above are fundamental elements of the basis of the bargain between iaptic and you.

7.4 Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. Accordingly, some of the above limitations may not apply to you.

7.5 Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury resulting from our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under French law

8. Termination

8.1 You may terminate these Terms at any time by:

  • Canceling your subscription through your account dashboard
  • Deleting your account
  • Discontinuing use of the Service

8.2 We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Engaging in fraudulent or illegal activities
  • Non-payment of fees
  • Upon request by law enforcement or government agencies

8.3 Upon termination:

  • Your right to use the Service will cease immediately
  • Your access to the Service will be disabled
  • Any outstanding payments will become immediately due
  • Service will continue until the end of your current billing period
  • No refunds will be provided for unused portions of your subscription

8.4 Data Retention and Deletion:

  • Upon termination, your data will be retained for 90 days
  • During this period, you may request an export of your data
  • After 90 days, your data will be permanently deleted or anonymized in accordance with our Privacy Policy and GDPR requirements
  • We may retain certain data as required by law or for legitimate business purposes

8.5 Sections 5 (Intellectual Property Rights), 7 (Limitation of Liability), and 13 (Confidentiality) survive any termination of these Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the Paris Commercial Court for B2B contracts or the Paris High Court for B2C contracts.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

12. Data Protection and Security

12.1 Data Processing

  • All data is processed and stored on servers located within the European Union
  • Primary data processing occurs in Germany and Finland through our hosting provider Hetzner

12.2 Security Measures

  • We implement and maintain industry-standard technical and organizational security measures
  • These include encryption of sensitive data (such as passwords), secure data transmission, and access controls
  • Our security practices are documented at iaptic.com/security

12.3 Data Breach Notification

  • We will notify you without undue delay, and in any case within 48 hours, of becoming aware of any personal data breach
  • Notification will include the nature of the breach, likely consequences, and measures taken
  • We maintain an incident response plan and will follow documented procedures in case of any security incidents

12.4 Privacy Policy

  • Our Privacy Policy, available at iaptic.com/legal/privacy-policy, details how we collect, use, and protect your data
  • We process all data in accordance with applicable data protection laws, including GDPR
  • You may request export or deletion of your data as described in our Privacy Policy

12.5 Data Processing Agreement By accepting these Terms and Conditions, you also agree to our Data Processing Agreement (DPA) available at iaptic.com/legal/dpa. This DPA defines our commitments regarding the processing of personal data in accordance with GDPR. The DPA is an integral part of these Terms and forms a legally binding agreement between you and us regarding the processing of personal data.

  • Our role as data processor and your role as data controller
  • The scope and purpose of data processing
  • Data security measures and breach notification procedures
  • Data retention and deletion policies
  • Sub-processor management
  • Compliance with data protection regulations

13. Confidentiality

We will maintain the confidentiality of any non-public information you submit to us in connection with your use of the Service, and will only use such information to provide the Service to you.

14. Force Majeure

Neither party shall be liable for any failure to perform its obligations under these Terms if such failure is due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war or terrorism, riots, labor disputes, or government actions.

15. Service Level Agreement (SLA)

15.1 Service Availability

  • We strive to maintain high service availability but do not guarantee specific uptime percentages
  • Scheduled maintenance will be announced at least 48 hours in advance through our status page at status.iaptic.com
  • Emergency maintenance may be performed without notice when necessary
  • Service status and incident history can be viewed at status.iaptic.com

15.2 Support Response Times

  • FREE tier: Best effort support via email
  • START tier: Email support with response within 2 business days
  • PRO tier: Email support with response within 1 business day
  • BUSINESS tier: Priority support with response within 4 business hours during business days
  • Business days are Monday through Friday, excluding French public holidays
  • Business hours are 9:00 AM to 6:00 PM Central European Time (CET/CEST)

15.3 Service Credits

  • In case of significant service disruption affecting your business operations, you may request service credits
  • Credits will be evaluated on a case-by-case basis
  • Maximum credit amount is limited to one month of service fees
  • Credits cannot be converted to monetary refunds
  • Free tier is not eligible for service credits

15.4 Exclusions Service level commitments do not apply to:

  • Scheduled maintenance windows
  • Force majeure events
  • Issues resulting from your actions or third-party services
  • Suspension or termination of your account in accordance with these Terms

16. Business Continuity and Disaster Recovery

16.1 Data Redundancy

  • Our database infrastructure maintains three copies of all data
  • Each copy is located in a different datacenter within the European Union
  • This architecture ensures data durability and availability

16.2 Infrastructure

  • Our infrastructure is maintained as code, enabling rapid recovery if needed
  • We maintain separate staging, pre-production and production environments
  • Service components are designed to automatically recover from common failure scenarios

16.3 Monitoring

  • Automated monitoring systems are in place to detect service issues
  • System status and incidents are publicly available at status.iaptic.com
  • We continuously work to improve our monitoring and response capabilities

16.4 Service Resilience

  • The Service architecture is designed for high availability
  • Multiple layers of redundancy are implemented for critical system components
  • Service status and incident history can be viewed at status.iaptic.com
